Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Zodiaq website and services at https://www.zodiaq.codes("Service"), operated by Zodiaq ("we," "us," or "our"). By accessing or using the Service, you agree to these Terms.

1. Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) to create an account and purchase a subscription. By using the Service, you represent that you meet this requirement and that all registration information you provide is accurate and complete.

2. Nature of the Service

Zodiaq provides Eastern astrology, Western astrology, compatibility analyses, forecasts, and related content generated from birth chart data. Zodiaq is provided for entertainment, educational, and personal reflection purposes only. All astrology, BaZi, compatibility, timing, naming, Feng Shui, and Ask Zodiaq answers are for entertainment only. Results are not guaranteed and should not be considered financial, legal, medical, investment, or professional advice.

Zodiaq is for entertainment and personal insight only. It is not financial, legal, medical, mental health, or professional advice. Do not rely on Zodiaq for decisions that require licensed professional guidance.

3. Account Registration

Accounts are created through Supabase Auth. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. You are responsible for entering accurate birth details. Report quality depends on the information you provide. Notify us immediately at team@everittventures.com if you suspect unauthorized access.

4. Purchases and Payments

Paid products are sold through Stripe on a per-report or subscription basis. By completing checkout, you authorize us to charge your payment method for the selected product. Prices are displayed at checkout. Payment details are processed by Stripe and are not stored directly by Zodiaq.

All Zodiaq products are digital products generated specifically for the customer based on information provided during checkout. Because digital reports, forecasts, compatibility readings, name analysis reports, date selection reports, Feng Shui reports, and Ask Zodiaq credits are delivered immediately and cannot be returned, all purchases are final.

Paid purchases are non-refundable unless required by law. If a technical issue prevents delivery of a purchased product, Zodiaq will make reasonable efforts to correct the issue and provide access to the purchased content.

5. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to reverse-engineer, scrape, or extract our calculation engines
• Share account credentials or resell reports without authorization
• Upload false birth data with intent to deceive others
• Interfere with or disrupt the Service or its infrastructure
• Circumvent subscription limits or access controls
• Use automated tools to generate excessive API or report requests

6. Intellectual Property

The Service, including its design, software, calculation engines, knowledge base, and report templates, is owned by Zodiaq and protected by copyright and other intellectual property laws. You receive a limited, non-exclusive, non-transferable license to access reports for personal use (or client use under Professional plans). You may not reproduce, distribute, or create derivative works from our content without written permission.

7. User Content

You retain ownership of birth data and questions you submit. By submitting data, you grant us a license to process it solely to provide the Service. We do not claim ownership of your personal chart interpretations as creative works separate from our platform.

8. Service Changes

Zodiaq may change, limit, or discontinue features over time. We may update plans, pricing, report formats, or availability as the product evolves.

9. Disclaimers

Zodiaq is provided for entertainment, educational, and personal reflection purposes only. All astrology, BaZi, compatibility, timing, naming, Feng Shui, and Ask Zodiaq answers are for entertainment only. Results are not guaranteed and should not be considered financial, legal, medical, investment, or professional advice.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY OF METAPHYSICAL INTERPRETATIONS, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT REPORTS WILL BE ERROR-FREE OR THAT OUTCOMES DESCRIBED IN REPORTS WILL OCCUR.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ZODIAQ AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE OR RELIANCE ON ANY REPORT CONTENT. OUR TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify and hold harmless Zodiaq from any claims, damages, or expenses arising from your violation of these Terms, misuse of the Service, or infringement of third-party rights.

12. Termination

We may suspend or terminate your account for violation of these Terms, non-payment, or at our discretion with notice. You may delete your account at any time from Account settings. Deletion is permanent. Upon termination, your right to access the Service ceases, though provisions that by nature should survive (disclaimers, liability limits, dispute resolution) will remain in effect.

You may delete your account at any time from Account settings. Deletion is permanent and removes personal reading details, profiles, and Ask Zodiaq history. Payment records may be retained where required for tax, fraud prevention, or financial compliance, but personal reading content is removed or anonymized.

Deleting your account does not automatically create a refund. Purchases remain non-refundable unless required by law.

13. Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles. Disputes shall be resolved through binding arbitration in accordance with the American Arbitration Association rules, except where prohibited by law.

14. Changes to Terms

We may modify these Terms at any time. Material changes will be posted on this page. Continued use after changes constitutes acceptance. If you disagree with updated Terms, you must stop using the Service and cancel your subscription.
